ACT Board of Supervisors Meeting

In Attendance: Dan Reis, Brandon Prichard by phone, Brian Masset, Terry Woehl, Jerry Kunz, Randy Strom, Roy Kuil, Dusty Hasper, and Sherry Leno
1. Call to Order
Chairman Reis called the meeting to order at 7:00 pm
2. Minutes Review
A. Corrections and approval of the minutes from the previous meeting.
Supervisor Prichard made a motion to approve the minutes from the April 6, 2026, meeting.

3. New Business
Todd from Apple Creek Country Club was in attendance to request approval of their yearly liquor license.
Dan made a motion to approve the Liquor License for Apple Creek Country Club.

4. Old Business
A. Rick Johnson Property
There has not been movement. Dan will contact the attorney.
B. Holzer Property
Myrtle Holzer was in attendance. She indicated that a 30-day eviction notice had been issued to the tenants. They have two weeks to vacate the property. Myrtle indicated that the property is back in her name. The tenants don't want to move, and they keep hauling stuff in. Dan suggested that Myrtle contact the sheriff. Myrtle indicated that she is tired of working with the sheriff. Myrtle indicated that she will do what needs to be done to get them out. The tenants have indicated they will take her to court.
C. Nathan Jensen property
The building located in the floodway is still there.
D. Vance Swinger property
Brian indicated that the board should sit on the issue. There are two side to every story. Neighbors are fighting.
5. Area Reports
A. School Board - Terry Woehl
The school board's regular meeting is on May 11th. There is an open house for all district residents. A meet and greet with administrators and teachers. The board is looking at options because the old building needs to be replaced.
B. Treasurer's Report - Randy Strom
Checking: $94,161.10 (two outstanding checks for 234.20 total = 93,926.40)
Savings: $119.86

1. Approve bills to be paid
Kelsch Law - $230.00
Kramer Agency - 380.00 (township insurance)
Supervisor Masset made a motion to approve the bills.

C. Assessors' Report - Marie Horning
Not in attendance
D. Building Inspector's Report - Burleigh County
The report was reviewed by the board.
Brian made a motion to approve the April report.

E. Road Supervisors Report - Roy Kuil
Roy indicated that work needs to be done on the asphalt roads in Apple Meadows. Dan indicated that the County will not be able to do these; we are on our own because of all the road damage in the County. The intent is to repair the roads and then work on a total reconstruction. Special assessments will be required, 60% of the residents of the development need to approve. Roads are 20+ years old. Three estimates are required. The County Engineer indicates there is a way to dig them out and repair. Dan and Casey from Burleigh County said they have never seen the roads like this in 25 years. Several people from Apple Meadows were in attendance, including Mike Greer, Darrin Johnson, and Mark Leingang. They indicated that patching will not do a whole lot of good; of the 2.5 miles of road, at least 40% are irreparable. They asked if the County's pavement zipper could be used; the County will have to answer that question. The residents of Apple Meadows will put a plan together to present to the board. Special Assessments are believed to be 15 years.
F. Weed Supervisors Report - Dusty Hasper
Dusty has a call into the Burleigh County Weed Board to make sure they are doing a match cost share again this year. No lawns or pastures, public right of ways only. Weeds such as Canadian thistle and leafy spurge. Keep spraying until gone. He will check the bad spots from last year.
6. Zoning Board
Chairman Reis called to recess the regular meeting and open the Zoning portion of the meeting.
Roll call: Dan - present, Brian - present, Brandon - present, Terry - present, Jerry - present.
A resident indicated that the Zoning Committee did not follow state law when it came to open meetings when working on the updated ordinance.
Dan indicated that this could be discussed without resolution. He will contact our attorney concerning the matter.
Chairman Reis closed the zoning board meeting and resumed the township meeting.
7. Adjourn
Dan adjourned the meeting at 8:02 pm.
