ACT Board of Supervisors Meeting

In Attendance: Dan Reis, Gaylen Dewing, Brandon Prichard (by phone), Jerry Kunz, Terry Woehl, Randy Strom, Roy Kuil, Marie Horning and Sherry Leno
1. Call to Order
Chairman Reis called the meeting to order at 7:00 pm
2. Minutes Review
A. Corrections and approval of the minutes from the previous meeting.
Supervisor Prichad made a motion to approve the minutes from the September 2, 2025 meeting.
Supervisor Dewing 2nd the motion
Vote: Dan - Yes, Galen - Yes, Brandon - Yes
Motion approved
Chairman Reis moved the zoning portion of the meeting to later because a person with zoning business was running late. Next order of business is Old Business.
3. Old Business
A. Rich Johnson Property 
The attorney will send another letter.  Jerry did visit with Rick, and he indicated the trailer would go, and he would be applying for a building permit for a modular home.  The shed would be cleaned up.  Jerry encouraged Rick to attend the meeting, but he said he didn't want to come to a meeting to discuss his business.  
B. Holzer Property
John pleaded guilty to charges, so it gives an additional 60 days to clean up the property.  Our attorney sent a letter on 10/3/2025 that indicated the camper needed to be removed along with the 4 families living in it.     
C. Ron King property
It appears he is starting to clean up.  Our lawyer will send another letter in about a week.
D. Nathan Jensen Property
Mitch Flanagan with the County told Dan that a building permit will not be issued until the building in the floodplain is moved out of the floodplain and the connex boxes are moved.  Mitch indicated that Nathan Jensen knows that.
E. Ordinance Committee Update and discussion
Terry indicated that a public hearing date needed to be set for the final reading of the ACT Comprehensive Plan and the 1st public hearing for the revised Zoning Ordinances.  This meeting was set for October 28th at 7:00 pm at the Apple Creek School.
F. ACT Comprehensive Plan
The 1st Reading of the Township Comprehensive Plan took place. Terry read the highlights of the Plan. Terry will make the School District changes. Discussion on land use and zoning also took place. Terry will rework that part of the plan for the final reading.
4. New Business
Chairman Reis made a motion to accept a tax abatement for a veteran household.
Gaylen 2nd the motion
Vote: Dan - Yes, Gaylen - Yes, Brandon - Yes
Motion approved
5. Zoning Board
Chairman Reis called to recess the regular meeting and open the Zoning portion of the meeting.
Roll call: Dan - present, Gaylen - present, Brandon - present by phone, Terry - present, Jerry - present
A. Terry recommended approval of the Huez request for a variance of a 28,000 sq ft outbuilding on his property per the application
Chairman Reis closed the zoning board meeting and resumed the township meeting.
Supervisor Dewing made a motion to approve the Huez building variance based on the final plat approval.

6. Area Reports
A. School Board - Terry Woehl
The School Board received a portable from Shiloh and will be moving it to the property.
B. Treasurer's Report - Randy Strom

Chair Reis made a motion to approve the bills.

C. Assessors' Report - Marie Horning
Marie reported she was fielding calls from realtors and updating records as necessary.
D. Building Inspector's Report - Burleigh County
Reviewed both the August and September reports - no permits issued in the Township
E. Road Supervisors Report - Roy Kuil
Roy indicated that Brooks is the new County Road Supervisor.  Brooks did not know why they bladed the gravel off of some roads 2-3 days after graveling was complete.  The roads were inspected, and they still meet standards.  The county has mowed ditches that needed mowing.  Roy continues to work on the 80th & Northgate issue.  May need to request the Attorney send a letter.
F. Weed Supervisors Report - Dusty Hasper
Nothing to Report.
