ACT Board of Supervisors Meeting

In Attendance: Dan Reis, Gaylen Dewing, Brandon Prichard, Jerry Kunz, Terry Woehl, Roy Kuil, Randy Strom and Sherry Leno
1. Call to Order
Chairman Reis called the meeting to order at 7:00 pm
2, Minutes Review
A. Corrections and approval of the minutes from the previous meeting.
Supervisor Dewing made a motion to approve the minutes from the April 7, 2025 meeting

3. Old Business
A. Amount of funds the township can have on hand
Dan is going to contact Genny from the ND Association of Counties concerning how much
money can be on hand.
B. Ordinance Committee - Terry
Terry indicated that the draft document was ready to be sent to the zoning board for
review and comment. The document will be sent in this order - 1 - Jerry, 2 - Brandon,
3 - Gaylen, 4 - Dan.
C. Rick Johnson Property
Dan said when he talked to Rick Johnson he could not make the April meeting but would
be at the May meeting, Rick Johnson did not show. Dan has visited with Rick Johnson a
few times concerning this matter.
Gaylen made a motion to work with the attorney to get the Rick Johnson property
addressed to be in compliane.

D. Holzer Property
Gaylen discussed the history of the Holzer Property. On March 17, 2025 the property at
9164 Bar D road was turned over to Mertyle's son John. Dan indicated he has had several
calls on Lot #1 from people who want to buy the property. Attorney has recommended
moving the judgement to Lot 2 - 9164 Bar D Road. Criminal case will be heaerd in June.
It was indicated that another camper is on Lot #1, the sheriff indicated that the camper
had been there.
Gaylen made a motion to authorize the attorney to continue with the judgement including
both lots.

E. Weight limit signs
The township truck ordinance was discussed at a Burleigh County Commission Meeting.
It was indicated that the ordinance was affecting development. The Burleigh County
Commission order the staff to take down the weight limit signs they had installed. Galen
indicated that there has been lots of mis-information about the truck ordinance. This
ordinance was not put into place to affect any business or development, it was simply put
into place to our roads. Dan indicated that the County Engineer and Casey have both
stated these road are not built for construction traffic. Rick indicated that it was a bad
move by Burleigh County to get involved.
Gaylen made a motion to purchase 3 weight limit signs, one at 80th and Lincoln Rd, one
at 22nd Ave & 66th St and one at 22nd & 93rd St.

E. Nathan Jensen Building
When the building permit was issued, it was clearly written on the permit that all laws
had to be followed, the building was built in the floodplain. Burleigh County has directed
that the building be moved out of the floodplain. A survey was completed and there is
higher ground that the building can be moved to. Nathan has indicted that he wants
ACT to pay for moving the building.
4. New Business
A. Cory and Amber Huez came to discuss what they need to do to get a special use permit
to construct a riding arena. The arena would exceed the allow square footage. They own 3
seperate properties that are all zoned differently. The Board of Supervisors indicated
that all properties need to be zoned the same. If the building conformed to the 4% rule
in ACT building ordinance they didn't need to come back. If they wanted to build bigger
it would require a request to the Zoning Board.
B. Microsoft Office 365 purchase for Township Clerk's laptop
This was tabled until the next meeting - clerk will do some more research
Area Reports
A. School Board Report - Terry Woehl
Teacher negotiations are complete.
Board decided not to pursue bids on the portable building located at the Lincoln School
B. Treasurers Report - Randy Strom
1. Approve bills to be paid

Motion approved.
We will also have to make change to our document storage managed by Fireside. The
clerk will contact Fireside to see how this is done since many of the folks on the account
have moved on.
C. Assessors Report - Marie Horning
Marie was not in attendance
D. Building Inspector's Report - Burleigh County
The clerk read the addresses and building types that occured in ACT

E. Road Supervisors Report - Roy Kuil
Burleigh County will gravel roads he choose. The cost will be approximately $113,000.
He will ask that they bring the gravel up from the sides of the roads.
F. Weed Supervisors Report - Dusty Hasper
Not in attendance - He visited with Dan and he indicate he would update the cost share
report at the June Meeting.
6. Zoning Board
Chairman Reis called to recess the regular meeting and open the Zoning portion of the
meeting.

Jerry - present
Terry revisieted the Burleigh County horse ordinance with the Huze's.
Gaylen requested that the horse ordinance be added to the new ordinances that are being
drafted.
Gaylen also indicatd that the township has the right to put up weight limit signs.
