Members Present: Chairman, Paul Zent; Supervisors Kerry Olson & Ken Selzler; Zoning Board members, Terry Woehl & Jerry Kunz; Assessor/Building Inspector: Ed Daniels; Treasurer, Shawn Whitney; Road Supervisor Loren Wolf and Clerk, Cyndy Meidinger.


Members Absent: Weed Board, Terry Mauch


Chairman Zent opened the meeting and the minutes from the previous meeting were called for and read. One correction was noted Greg & William Backhaus requested the public hearing not Chris & William Backhaus as stated in the minutes. With no other corrections or additions Supervisor Olson made a motion to approve the minutes as read 2nd by Supervisor Selzler. The motion was unanimously approved with Supervisors, Olson, Selzler and Chairman Zent voting in favor of the motion, Motion Carried.


School Board Update: There was no one present from the school board to give any update; but Supervisor Selzler had a parking lot update. He has 2 more loads of crushed asphalt coming for the parking lot but he does not know if it will be delivered this year or in the spring due to the weather. So far the cost to the township for the parking lot redo is $1,159.11 that is for material and fuel. The equipment rental and labor has all been donated.


Road Supervisor’s Report: The board reviewed the maintenance agreement for 2011 a discussion followed with Supervisor Olson making a motion to approve the payment of $10,594.71 to Burleigh County for the 2011 maintenance agreement Supervisor Selzler 2nd the motion. The motion was unanimously approved with Supervisors Olson, Selzler and Chairman Zent voting in favor of the motion, Motion Carried. The supervisors will meet with Road Supervisor Wolf in the spring to road trip the township roads to determine what roads need gravel and how much. Apple Creek Country Club Roads were discussed and Road Supervisor Wolf had talked to Rodney Ness from the county and the county considered all streets in the Country Club private drives. Mr. Ness also said the county is going to take a look at the fee charged to the Country Club. At this time the cost does not even cover expenses. This will take some time to fix the problem for now it is in the hands of Burleigh County and the Country Club Association. Supervisor Wolf said the request to move an approach @ 12551 22nd Ave. will have to go through the county since 22nd Ave is a county road. Supervisor Wolf also reported any roads that had the chloride treatment on them were not graded because the treatment made the road too hard.


Weed Board: No report.


Zoning Board: The regular meeting was suspended by Chairman Zent, to open the Zoning Board for a Public Hearing. William Backhaus requested a special use/variance on behalf of his son Greg to allow a taxidermy business out of his garage @ 11441 Hillard Drive, Menoken, ND. Mr. Backhaus had discussed the proposed business venture with Ted Mees who is on the covenant committee for Mees Country Home Estates. Mr. Mees gave approval to operate a business out of the home and was ok with a sign for advertising of said business. A discussion followed resulting in the following: If granted the variance will be re-evaluated in 3 years (Jan 2011-Jan 2014) the board is ok with the business in the garage and a 2’x4’ sign to advertise said business. Supervisor Selzler made a motion to approve the request from William Backhaus for a temporary variance allowing a taxidermy business & sign, 2nd by Supervisor Olson. The motion was unanimously approved with Supervisors Selzler, Olson and Chairman Zent voting in favor of the motion, Motion Carried. Chris Nyhus outlined some points for the Zoning Regulation rewrite. He would email members of the board and zoning board with the suggested zoning rewrite for the members to review. Chairman Zent wanted the regulations proofed and any corrections or additions be brought to his attention by the 19th of December. He would pass along any changes to Chris so the township could have a pdf file and a hard copy @ the January meeting. With no other zoning issues to discuss Chairman Zent adjourned the Zoning Board and reconvened the regular meeting of ACT.


Assessor/Building Inspector Report: Inspector Daniels had no assessor report he also said there had been 40 building permits issued in Apple Creek Township for the year and Bismarck had issued 197 permits in the township for the year. Most of Bismarck’s permits had been in the Copper Ridge Development. He did have one permit from Buck Olson @ 8460 Windmill Road for a 16’x36’ pole building.

Other Business: Supervisor Olson attended the NDTOA meeting @ the Doublewood Inn and reported the body had voted to increase the dues to the state by $25.00 for a total of $125.00 for a year. He also said the townships will have to get a better handle on their assessors or face losing control of their assessing ability.
Chairman Zent asked the board for volunteers to help move the file cabinets and take out some shelving in the new office space. This will be done on Dec 27th during Christmas break. Clerk Meidinger will contact members to remind them of the project. With no other business to discuss Chairman Zent adjourned the meeting. The next meeting will be Jan 10th 2011.
